Résumé
Faut-il punir, faut-il soigner ? Un criminel, un délinquant est arrêté. S'il a besoin de soins psychiatriques, c'est l'autorité administrative qui le fait hospitaliser sous contrainte, sans intervention de la justice et sans préjuger de sa responsabilité. Cette responsabilité est déterminée ultérieurement par la justice.
Abstract
Does he need a punishment or a medical cure ? A criminal offender is arrested. If he needs psychiatric care, he is compulsorily committed to a hospital by the police authority and not by the justice, regardless of his responsibility. This responsibility will be appreciated by the justice afterwards.
